ROM Site Lawsuit Brings Nintendo A $12 Million Win

That’s a lotta spaghetti.

Earlier this year, Nintendo sued the owners of ROM sites LoveROMS and LoveRETRO. And it’s worked out for them, as an Arizona judge has awarded the big “N” a $12,230,000 settlement.

The sites, both owned by married couple Jacob and Cristian Mathias, have long since been taken offline. The couple eventually went into settlement negotiations with Nintendo to avoid a dragged out legal battle. According to TorrentFreak, both sides have agreed to a consent judgment. Per the currently unsigned judgment documents:

Plaintiff is hereby awarded judgment against all Defendants, jointly and severally, in the amount of $12,230,000

The Mathiases also agreed to a permanent injunction, which prevents them from ever violating Nintendo copyright again. The injunction entails not only signing over the sites to Nintendo, but also forfeiting all Nintendo games and emulators they have.

As to whether the couple will actually be forced to pay the full $12 million is uncertain. A lot of these sorts of deals often have their value negotiated down behind closed doors. But most importantly, the case may be used as a form of deterrent to other ROM sites.
