I don’t know why they’re going for individual cheaters like this.
Epic has been taking cheating in Fortnite very seriously of late. They’ve recently filed 2 suits against a pair of cheaters for promoting cheating utilities. The problem? One of the two is legally considered a minor. And his Mom isn’t happy with them over it.
The defendant’s mother contends that by going after her son instead of the providers of the cheating software, they’re using him as a scapegoat. She also contends that her son had no part in developing the utility, in addition to not giving her son parental consent, as Fortnite’s EULA requires.
Epic, on the other hand, sings a different tune. In a statement given to Kotaku:
This particular lawsuit arose as a result of the defendant filing a DMCA counterclaim to a takedown notice on a YouTube video that exposed and promoted Fortnite Battle Royale cheats and exploits. Under these circumstances, the law requires that we file suit or drop the claim.
Epic is not okay with ongoing cheating or copyright infringement from anyone at any age. As stated previously, we take cheating seriously, and we’ll pursue all available options to make sure our games are fun, fair, and competitive for players.
While they have every right ban users for cheating, Epic may have made a blunder by going after individuals like this. Especially considering that the state the kid is in, Delaware, happens to have laws that forbid exposing a minor’s information in this way. And it gets even worse when you consider that most similar suits filed against minors like this tend to fail. It might be wiser for Epic to cut their losses and go after the actual developers of the utility itself, rather than every Fortnite cheater individually.
