Nintendo Sues A Couple of ROM Sites

Nintendo has filed suit against two large ROM sites, which it alleges are owned by the same person. The sites in question are LoveROMS and LoveRETRO. And Nintendo is seeking millions in damages against them.

Nintendo has filed suit against the alleged parent company of those sites in Arizona. According to a PDF of the suit (via TorrentFreak), Nintendo alleges that the Arizona-based Mathias Designs, owned by Jacob Mathias, has been distributing Pirated games and other copies through the sites. From the PDF:

The LoveROMs website alone receives 17 million visitors each month. Such visitors are drawn to the website by the widespread availability of free, unauthorized copies of Nintendo’s video games and other highly valuable intellectual property.

It goes on:

The resulting popularity of Defendants’ LoveROMs and LoveRETRO websites has allowed Defendants to reap substantial ill-gotten gains, including through donations and the sale of advertising on the LoveROMs and LoveRETRO websites.

Both sites are currently down (and, honestly, likely to stay that way).

In this case, Nintendo is seeking $150,000 in damages per Nintendo game, and up to $2,000,000 per trademark infringed. And there’s no doubt those numbers are meant to send a message. Because if you add that up even with conservative numbers, that’s a whole lot of money.
